Welcome to Dejected Artist. These Terms of Service ("Terms") govern your use of this website and any purchases made through it. By accessing or using this website, you agree to these Terms. If you do not agree, please discontinue use immediately.

• This website is owned and operated by Dejected Artist.
• I reserve the right to update or modify these Terms at any time without prior notice. Continued use of this website constitutes acceptance of any changes.
• These Terms apply to all sales, interactions, and content on this website.

• All prices are listed in USD (United States Dollar) and are subject to change without notice.
• Payments are securely processed via [Stripe, PayPal, or another verified payment provider].
• I do not store or have access to your payment information.
• Customers are responsible for any applicable taxes, duties, or fees imposed by their country or state.
• Fraudulent Transactions: I reserve the right to refuse or cancel any order if fraud, unauthorized use of a payment method, or pricing errors are suspected.

• All sales are final. No refunds, returns, or exchanges will be granted under any circumstances.
• Each original painting is one-of-a-kind and may have slight imperfections due to the artistic process.
• Color & Appearance Disclaimer: Items may appear different in real life than in photos due to lighting, camera settings, and screen variations. While I make every effort to represent my artwork accurately, slight differences in color, texture, and detail may occur.
• I reserve the right to refuse or cancel any order at my discretion, including but not limited to suspected fraud or pricing errors.

• All original artwork is shipped with insurance to protect against damage during transit.
• Signature authorization is required for delivery of all original artwork to ensure safe and verified receipt.
• All orders are shipped with tracking. Customers are responsible for providing the correct shipping address.
  • If a package is returned due to an incorrect address, the customer is responsible for reshipment fees.
• Lost or Stolen Packages: Once an order has shipped, I am not liable for lost or stolen packages. Please contact the shipping carrier for assistance.
• Customs Delays & Import Fees: If your order is held in customs, this is outside of my control, and I am not responsible for any additional fees or delays.
• Damaged Packages: If your artwork arrives damaged, you must contact me within 48 hours of delivery with photos of the damage and packaging.
• Shipping Delays: I am not responsible for delays caused by shipping carriers, customs, or unforeseen events.

• All artwork, images, text, and content on this site are the exclusive intellectual property of Dejected Artist.
• Purchasing artwork does not grant you reproduction, modification, or commercial rights.
• You may not reproduce, distribute, resell, or create derivative works from my art without written permission.
• Unauthorized commercial use (including prints, NFTs, resale, AI-generated recreations, or AI training datasets) is strictly prohibited and may result in legal action, licensing fees, and/or fines.

• Custom artwork orders are final sale. No refunds, changes, or cancellations once work has begun.
• A non-refundable deposit may be required before work starts.
• If the client fails to complete payment, they forfeit all rights to the artwork, and I retain full ownership.
• If delays are caused by the client’s lack of response, indecision, or failure to provide necessary information, no refund will be issued.

By using this site, you agree to:

• Use it for lawful purposes only and not engage in fraudulent, abusive, or harmful activities.
• Not copy, distribute, or misuse site content in any way without permission.
• Not attempt to hack, disrupt, or interfere with the functionality of this website.
• I reserve the right to restrict or terminate access to my site for any user who violates these Terms.

• I am not liable for any indirect, incidental, or consequential damages resulting from the use of this site or the purchase of my artwork.
• Artwork is sold "as-is," and I make no guarantees regarding longevity beyond the provided care instructions.
• Any implied warranties (including merchantability, fitness for a particular purpose, or durability) are expressly disclaimed.
• In no event shall my liability exceed the total amount paid for the artwork purchased.

• Any disputes will first be attempted to be resolved informally via email at 📧 info@dejectedartist.com.
• If no resolution is reached, disputes shall be handled in Chicago, Illinois, USA, and governed by Illinois state law.
• By purchasing from this website, you agree to waive any class action rights and handle disputes on an individual basis.

I am not responsible for delays or inability to fulfill orders due to events beyond my control, including but not limited to:

• Natural disasters (earthquakes, floods, wildfires, etc.)
• Shipping carrier disruptions (lost shipments, strikes, etc.)
• Power outages or internet failures
• Personal illness or emergency situations

• I reserve the right to update or modify these Terms at any time.
• Continued use of this website or purchases made after changes are posted means you accept those changes.
